CourtCaseLookup Terms of Use

These Terms of Use govern your access to and use of CourtCaseLookup, including the website, dashboard, upload tools, lookup tools, screenshots, search history, account features, subscription plans, credits, and related services.

By creating an account, accessing the platform, uploading information, purchasing credits, submitting a lookup, clicking "I Agree," typing your name, applying an electronic signature, or otherwise using CourtCaseLookup, you agree to be bound by these Terms of Use.

If you do not agree, you must not access or use the platform.

1. Definitions

"CourtCaseLookup," "we," "us," or "our" means the owner/operator of the CourtCaseLookup platform.

"Platform" means the CourtCaseLookup website, dashboard, upload tools, lookup tools, search tools, records, screenshots, reports, account pages, and related software features.

"User," "you," or "your" means the person or entity creating an account, accessing the platform, uploading information, submitting lookups, purchasing credits, or using the service.

"Lookup" means a search, attempted search, automated check, batch check, or retrieval attempt submitted through the platform.

"Credits" means prepaid or subscription-based lookup units used to submit or process searches.

"Submitted Information" means information entered, uploaded, imported, or submitted by a user, including ICON/location code, ticket number, first three letters of a last name or business name, offence date, internal file number, notes, or other information.

"Results" means information retrieved, displayed, stored, or generated through the platform, including court date information, case status, payable amount, screenshots, timestamps, and not-found results.

2. Nature of the Service

CourtCaseLookup is a software-as-a-service tool designed to assist users with organizing and checking Ontario Provincial Offences Act ticket/case information based on user-submitted lookup details.

CourtCaseLookup is not a court, tribunal, government agency, municipality, law firm, paralegal firm, legal representative, or legal advice provider.

The platform does not provide legal advice, legal opinions, legal representation, deadline monitoring advice, litigation advice, procedural advice, or professional judgment about any ticket, charge, court date, limitation period, appeal period, reopening request, trial request, conviction, fine, or legal proceeding.

3. No Affiliation With Government or Courts

CourtCaseLookup is not affiliated with, endorsed by, operated by, or authorized by the Government of Ontario, the Ministry of the Attorney General, any Ontario court, any municipality, any prosecutor's office, or any government payment or lookup portal.

The platform may rely on information available from public, court, municipal, or third-party systems. We do not control those systems.

4. User Responsibility to Verify Information

You remain solely responsible for reviewing, confirming, and independently verifying all information before relying on it.

This includes, but is not limited to: court dates; court times; courtroom information; case status; conviction status; fine amounts; payable amounts; filing deadlines; appeal deadlines; reopening deadlines; trial request deadlines; adjournment information; enforcement status; suspension or default information; screenshots; timestamps; and not-found results.

You must not rely on CourtCaseLookup as the sole source of truth for urgent, same-day, deadline-sensitive, appeal-sensitive, enforcement-sensitive, or limitation-sensitive matters.

5. No Guarantee of Accuracy, Completeness, or Availability

CourtCaseLookup does not guarantee that any lookup, result, screenshot, court date, case status, fine amount, payable amount, ticket record, or court information will be accurate, complete, current, available, uninterrupted, or suitable for any particular purpose.

Results may be affected by incorrect or incomplete user-entered information, outdated information, formatting errors, changes to court/public systems, downtime, captcha or anti-bot restrictions, delayed court updates, missing records, duplicate records, court or municipal data errors, system errors, network interruptions, screenshot capture errors, third-party website changes, or search limitations.

You accept these risks when using the platform.

6. User-Submitted Information

You are solely responsible for the accuracy, legality, and authorization of all information you enter, upload, import, or submit to the platform.

You represent and warrant that: you have authority to submit the information; you have any required client authorization or consent; you are not submitting information for an improper or unauthorized purpose; the information is accurate to the best of your knowledge; and your use of the platform complies with all applicable laws, rules, regulations, professional obligations, and client obligations.

7. Professional and Law Society Obligations

If you are a lawyer, paralegal, licensee, student, clerk, employee, contractor, agent, or legal services provider, you remain solely responsible for complying with all professional, ethical, confidentiality, client-identification, practice-management, supervision, court, tribunal, and Law Society obligations applicable to you.

CourtCaseLookup does not supervise your practice, manage your files, confirm your deadlines, advise your clients, or replace your professional judgment.

You are responsible for determining whether your use of the platform is appropriate for your practice, clients, files, and obligations.

8. Account Registration and Profile Information

You agree to provide accurate, current, and complete account and profile information, including your name, contact information, company name, and professional licence information where applicable.

You agree to promptly update your information if it changes.

We may suspend or terminate your account if we believe your profile information is inaccurate, incomplete, misleading, unauthorized, or associated with misuse of the platform.

9. Account Security

You are responsible for maintaining the confidentiality of your login credentials.

You must not share your account with unauthorized users, allow another person to use your credentials, sell or transfer access, bypass account or credit limits, access another user's account, or use the platform for unauthorized third-party searches.

You are responsible for all activity under your account.

10. Credits, Subscriptions, and Lookup Usage

Credits are used to submit or process lookups. One lookup credit is consumed per ticket lookup submitted or processed.

As an automatic courtesy: any credit charged for a lookup that returns no matching record from the court/public system will be restored to your account when CourtCaseLookup detects the not-found result. Reconciliation occurs the next time you view your active-tickets dashboard or initiate another lookup.

Credits are not refunded for: lookups that successfully return a court record (even if the user later disputes the data); subscription billing periods, which are non-refundable per Section 11; or successful lookups that were submitted with incorrect, incomplete, outdated, or invalid user-supplied information where a record was nonetheless returned.

Unused monthly subscription credits expire at the end of the applicable billing period unless rollover is expressly included in your plan. We may also, at our discretion, restore credits for lookups that fail because of a platform-side technical error.

We may change pricing, plans, credit packages, or subscription terms on notice to users.

11. No Refunds Except Where Required

All purchases, subscriptions, and credit packages are final and non-refundable except where required by law or expressly approved by CourtCaseLookup in writing.

We may, at our discretion, issue a credit, account adjustment, or goodwill refund. Doing so does not create an obligation to do so again.

12. Uploads, Validation, and Import Errors

The platform may provide upload validation tools to identify missing or improperly formatted information.

Validation tools are provided for convenience only. They do not guarantee that submitted information is correct, complete, searchable, or sufficient to return a result.

You remain responsible for checking all uploaded data before submitting lookups.

13. Screenshots and Records

The platform may capture or store screenshots, timestamps, lookup results, or search history.

Screenshots and stored results are provided for convenience and audit purposes only. They may not reflect later changes to the court/public system.

You remain responsible for confirming whether information has changed after a lookup is completed.

14. Acceptable Use

You agree not to use the platform to violate any law or regulation; violate professional obligations; conduct unauthorized searches; harass, monitor, or investigate individuals for improper purposes; upload information you are not authorized to use; reverse engineer the platform; scrape, copy, resell, or reproduce platform data; bypass rate limits, credit limits, authentication, or security features; interfere with platform operation; use automated scripts outside approved platform features; introduce malware or harmful code; or misrepresent the platform as an official court or government system.

15. Service Availability

We may modify, suspend, interrupt, restrict, or discontinue the platform at any time, including for maintenance, updates, security, third-party changes, technical issues, or business reasons.

We do not guarantee uninterrupted access.

16. Third-Party Systems

The platform may depend on third-party websites, public portals, court systems, municipal systems, hosting providers, payment processors, email providers, analytics tools, or security tools.

We are not responsible for third-party outages, restrictions, errors, data changes, downtime, access blocks, captcha changes, policy changes, or unavailability.

17. Privacy and Data Protection

Your use of the platform is also governed by our Privacy Policy.

By using the platform, you consent to the collection, use, storage, and disclosure of information as described in the Privacy Policy.

We aim to minimize the information required to perform lookups. However, you are responsible for ensuring that any information submitted to the platform is authorized and appropriate.

18. Confidentiality

We will take reasonable steps to protect user account information and submitted information.

However, no internet-based platform can guarantee absolute security.

You acknowledge that you are responsible for deciding whether the platform is appropriate for your confidentiality obligations and client-related information.

19. Intellectual Property

CourtCaseLookup, including its website, software, workflows, user interface, design, text, graphics, branding, code, features, and documentation, is owned by or licensed to CourtCaseLookup.

You receive a limited, revocable, non-exclusive, non-transferable licence to use the platform for your internal business or professional purposes in accordance with these Terms.

You do not acquire ownership of the platform or its intellectual property.

20. Beta Features

We may offer beta, test, experimental, or preview features.

Beta features may be incomplete, unstable, inaccurate, or discontinued at any time.

You use beta features at your own risk.

21. Suspension and Termination

We may suspend or terminate your account if we believe that you breached these Terms, provided false or misleading profile information, misused the platform, created legal/security/operational/reputational risk, failed payment, attempted to bypass platform restrictions, or used the platform for unauthorized purposes.

Upon termination, your access to the platform may be disabled.

22. Disclaimers

The platform is provided on an "as is" and "as available" basis.

To the maximum extent permitted by law, we disclaim all warranties, representations, and conditions, whether express, implied, statutory, or otherwise, including warranties of accuracy, availability, merchantability, fitness for a particular purpose, non-infringement, reliability, and uninterrupted service.

23. Limitation of Liability

To the maximum extent permitted by law, CourtCaseLookup's total liability for any claim arising out of or relating to the platform, these Terms, any lookup, any result, any screenshot, any subscription, or any user's reliance on the platform shall not exceed the amount paid by the user to CourtCaseLookup in the three months immediately preceding the event giving rise to the claim.

24. Exclusion of Damages

To the maximum extent permitted by law, CourtCaseLookup shall not be liable for missed court dates, missed deadlines, missed appeal periods, missed reopening periods, missed filing dates, client complaints, professional negligence claims, disciplinary complaints, lost profits, lost revenue, loss of business, reputational harm, loss of goodwill, loss of data, indirect damages, consequential damages, incidental damages, special damages, punitive damages, reliance damages, damages arising from third-party systems, damages arising from user-entered information, or damages arising from unavailable or inaccurate court/public data.

25. Indemnity

You agree to indemnify and hold harmless CourtCaseLookup, its owners, directors, officers, employees, contractors, service providers, and affiliates from any claims, demands, losses, damages, costs, expenses, legal fees, complaints, regulatory issues, or proceedings arising from your use of the platform, your submitted information, your breach of these Terms, your breach of professional obligations, breach of client confidentiality, unauthorized searches, reliance on lookup results, failure to verify information, misuse of credits or account access, or any claim brought by your client, employer, contractor, staff member, or third party.

26. Electronic Acceptance and Signature

You agree that your electronic acceptance of these Terms, including clicking "I Agree," typing your name, applying an electronic signature, checking acknowledgment boxes, or using the platform, is intended to be your electronic signature and has the same effect as signing a written agreement.

You consent to receive and accept these Terms, the Privacy Policy, notices, records, and account communications electronically.

We may store records of your acceptance, including timestamp, IP address, user agent, account details, signature, Terms version, Privacy Policy version, and related audit information.

27. Changes to These Terms

We may update these Terms from time to time.

If we make material changes, we may require you to accept the updated Terms before continuing to use the platform.

Your continued use of the platform after updated Terms become effective means you accept the updated Terms.

28. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.

The courts of Ontario shall have jurisdiction over disputes arising from or relating to these Terms or the platform, unless applicable law requires otherwise.

29. Entire Agreement

These Terms, together with the Privacy Policy and any applicable subscription or pricing terms, form the entire agreement between you and CourtCaseLookup regarding your use of the platform.
